BATTLE TRUCK LV ACKNOWLEDGEMENT OF RISK AND RELEASE (“‘Agreement”)
I or the Parent/Guardian executing this Agreement. hereby acknowledge that I or the Parent/Guardian executing this Agreement have voluntarily applied to enter onto and to engage in or to observe shooting and other activities at the Mobile shooting range at Battle Truck LV. (“Battle Truck LV”) (“Mobile Range”).
I or the Parent/Guardian executing this Agreement acknowledge and understand that shooting activities are inherently hazardous and involve both known and unanticipated risks which could result in damage or destruction of property and cause serious physical or emotional injury, including paralysis, death, and partial or total loss of eyesight or hearing, of myself or of other persons. The risks include, but are not limited to: being shot by myself or others; being struck by flying or falling BB’s and other objects; malfunctioning equipment; user error by myself or others. I understand that such risks cannot be eliminated without compromising the essential qualities of shooting activities.
I or the Parent/Guardian executing this Agreement further acknowledge and understand that the nature and condition of the Mobile Range facilities, premises and environment is such that both known and unanticipated hazards exist which create or contribute to both known and unanticipated risks inherent in entering onto the Mobile Range, in using Mobile Range facilities and in engaging in or observing any activities while at the Mobile Range. These hazards include, but are not limited to: flying BBs; loose BBs; slippery floor; and equipment malfunction. I understand that such hazards and risks cannot be eliminated without compromising the essential qualities of the Mobile Range facilities, equipment, premises, and environment.
I or the Parent/Guardian executing this Agreement further acknowledge and understand that Battle Truck LV has no duty to undertake first-aid or rescue operations or procedures in the event that any such property damage or physical or emotional injury occurs, and that any such operations or procedures may result in compounded or increased damages or injuries.
I or the Parent/Guardian executing this Agreement further acknowledge and understand that Battle Truck LV makes no warranty as to the design, manufacture, maintenance, condition or fitness for any particular purpose of any Mobile Range facilities or equipment, including, but not limited to: Air soft rifles, ammunition, eye/hearing protection, and first-aid supplies. As lawful consideration for being permitted by Battle Truck LV to enter on to the Range. to use Range facilities or equipment and to engage in or observe shooting and other activities at the Range, as either a customer or a Guest, I or the Parent/Guardian executing this Agreement agree as follows: I or the Parent/Guardian executing this Agreement EXPRESSLY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS EXISTING ON THE MOBILE RANGE AND IN ENTERING ON TO THE MOBILE RANGE AND IN USING MOBILE RANGE FACILITIES OR EQUIPMENT AND IN ENGAGING OR OBSERVING SHOOTING AND OTHER ACTIVITIES AT THE MOBILE RANGE.
I or the Parent/Guardian executing this Agreement agree to abide by all Battle Truck LV & Mobile Range rules.
I or the Parent/Guardian executing this Agreement AGREE that I, my next of kin, heirs, guardians, representatives and assigns HEREBY RELEASE AND FOREVER DISCHARGE AND AGREE NOT TO SUE Battle Truck LV as well as its officers. directors, attorneys, agents, employees, contractors, volunteers, guests, and any affiliated individuals or organizations (“RELEASES”) from and against any and all claims, demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever, that I, my next of kin, heirs, guardians, representatives or assigns may have for property damage, personal injury or death resulting from my entering on to the Mobile Range, using Mobile Range facilities or equipment, or engaging in or observing shooting and other activities at the Mobile Range, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result partially or wholly from any act or acts, even any negligent act or omission to act, including negligent or omitted first-aid or rescue operations or procedures, by Battle Truck LV.
I or the Parent/Guardian executing this Agreement further acknowledge and agree that this Agreement is intended to be as broad and inclusive as permitted by law, and that if any provision or portion is held to be invalid, void or otherwise unenforceable, I or the Parent/Guardian executing this Agreement agree and intend that the remaining provisions or portion shall continue and remain in full legal force and effect.
I further acknowledge and agree that it is my understanding and intent that this Agreement, and any signed written amendments or modifications to it, shall remain in full force and effect from the date of execution and ever after and shall be applicable to each and every occasion that I or the Parent/Guardian executing this Agreement enter on the Mobile Range, use Mobile Range facilities or equipment or engage in or observe shooting and other activities at the Mobile Range.
I or the Parent/Guardian executing this Agreement have carefully read this *Acknowledgement of Risk and Release Agreement” and fully know its contents. I or the Parent/Guardian executing this Agreement acknowledge that no other inducement, assurance or guarantee has been made to me in consideration of my signing this Agreement, which I or the Parent/Guardian executing this Agreement sign voluntarily and of my own free will.
I or the Parent/Guardian executing this Agreement further Acknowledge and agree that this Agreement may be amended or modified only by a writing signed by me and by and authorized agent of Battle Truck LV. Photo/Video Release: Releasor hereby grants to Battle Truck LV and/or its photographers the absolute and irrevocable right and unrestricted permission to take, use, reuse, publish, republish, transmit, display, and copyright photographic portraits, pictures, or videos of me, my name, my likeness, my voice. and/or appearance, still or moving, or in which I may be included, in whole or in part, or composite or distorted in character of form, without restriction as to changes or alterations, in conjunction with my own or fictitious name, or reproductions thereof in color or otherwise, made through any medium at its studios or elsewhere. and in any and all media now or hereafter known, in print or electronically, for any purpose whatsoever, without notifying me, including but not limited to any web content, publications, illustrations, promotions, advertisements, posters, trade, or any other purpose whatsoever, and to use with or without my name in connection with any use if it so chooses. I hereby waive any right that I may have to inspect and approve the finished product or copy that may be used in connection with an image or a video that the Photographer has taken of me, or the use to which it may be applied. I waive any right to be compensated for the usage of the materials and any royalties arising from the usage of the materials. I agree that Photographer owns the images and all rights relating to them.
